Please read these Terms and Conditions carefully before using or requesting our services. These services are available to you via the Brown-hill Chauffeurs Mobile Application or website. This document includes important information about the services we provide, your rights, and other essential details

KEY PRINCIPLES

  • These terms will apply to Brown-hill Chauffeurs mobile application (customer app), our website e-booking in the UK, however, you can also make booking via our email or call control office (see below ABOUT US for details), this pattern enable you to request services directly for Brown-hill Chauffeurs.
  • Brown-hill Chauffeurs Offers Executive Transportation services, you are contracting directly with Brown-hill Chauffeurs for the provision of our services.

  • Brown-hill Chauffeurs or their passengers reserve the right to cancel the journey prior to booking time (see below CANCELLATIONS AND CANCELLATION CHARGES), However, drivers may refuse the journey but exclude their right to cancel the journey/booking made by the customer as Brown-hill Chauffeurs.

  • Brown-hill Chauffeurs is responsible for the journey/bookings once accepted, all bookings accepted by Brown-hill Chauffeurs, gives rise to legal binding contract between Brown-hill Chauffeurs and the customers.

  • In order to provide Brown-hill Chauffeurs transportation services, Brown-hill Chauffeurs accepts booking as a private hire vehicle operator (under the TFL issued private hire vehicle operator licence) for the purpose of private hire legislation and regulation applicable in the UK.
  • Our terms and conditions stated in this agreement cover your use of Brown-hill Chauffeurs transportation services.
  • Brown-hill Chauffeurs will time to time update and/or amend our terms, please regularly check our terms and conditions on our website before you use the Brown-hill Chauffeurs mobile app, website, or contact us via telephone or email for the latest information.

DEFINITIONS

“Brown-hill Chauffeurs” means Brown-hill Chauffeurs, (“we” or “us”)
Brown-hill Chauffeurs App /Website and services means that the services provided to you by Brown-hill Chauffeurs, comprises of:
Access to our services or/and use of Brown-hill Chauffeurs mobile application, our website, you can also contact us for booking journeys by emailing us at bookings@brown-hillchauffeurs.co.uk , or call us at our call control office +44 7877 622145, enabling you to request and receive Brown-hill Chauffeurs provided transportation services. “Booking” means a booking of Brown-hill Chauffeurs Transportation Services.
“Legislation” means the Acts and any regulations made pursuant to the Acts, including any related local government regulations pertaining to the operation of PHVs.
“PHV” means private hire vehicle. “Third Party Providers” are independent third parties and include, but are not limited to, independent transportation providers, travel providers, leisure providers, couriers, logistics providers, and/or providers of other mobility services.
“Brown-hill Chauffeurs Transportation Service” means the provision of the passenger journey which is the subject of a booking accepted by Brown-hill Chauffeurs as set out in these Terms.

GENERAL TERMS

OVERVIEW

These terms cover your access and use of our customer App/Website, email booking at bookings@brown-hillchauffeurs.co.uk , or control office booking via +44 7877 622145 for use of our services (the “Terms”).
You as a customer must read carefully and agree to the terms prior to accessing and using our App/Website Services. These Terms expressly supersede prior agreements (if applicable/existed) or arrangements about the App/Website Services (as defined below) between you and Brown-hill Chauffeurs.

Any method or source you use to make booking with us such as our App/Website Services, email, or control office booking, you confirm that you accepted our Terms.

However, if contacting you is mandatory, we will do so by phone call, text message or email, using the details you provided to us on registration for our mobile application. When we use the words “writing” or “written” in these terms, this includes emails or texts.

BROWNHILL GROUP LIMITED

Brown-hill Chauffeurs is a Private Hire vehicle Operator providing Executive Transportation Services to our clients/customers within the United Kingdom only, you will be in directly contracting with the Brown-hill Chauffeurs which has accepted your booking as the relevant private hire vehicle operator licence issued by TFL.

The Terms and Conditions outlined herein shall apply to and regulate the contractual relationship between “Brown-hill Chauffeurs” and “the Customer”, including any of its authorised personnel and drivers and “the Customer” is any party who accepts an offer of the Company i.e., Transportation Services.
“The Services” shall include, but not be limited to, any and/or all carriage, courier, or delivery ser-vices, provided by the Company to the Passenger during the duration of this Contract.
The Company reserves the right to use the services of third parties (i.e., contractors or sub-contractors) to provide Services to the customers.

THE CONTRACT

By entering into a contract with Brown-hill Chauffeurs, you agree to the Terms and Conditions set out in this document.

The contract becomes binding only when Brown-hill Chauffeurs accepts your booking based on your reservation request. These Terms and Conditions will govern the entire agreement.

A request for a booking constitutes an offer by you (customer) to purchase our Executive Transportation Services in accordance with these Terms. This Booking request will set out the main characteristics of our Executive Transportation Services.

Once we accept your offer, we will send you a confirmation by text message, email, or push notification. This confirmation will include details such as vehicle information, pick-up and drop-off locations, date, and time. At this point, the contract between you and Brown-hill Chauffeurs is established.

We will provide you with estimated times for driver arrival and journey completion. However, these times are for reference only and are not guaranteed.

Brown-hill Chauffeurs is not obligated to accept every booking request. We may decline a booking for any reason. If the assigned driver becomes unavailable after we confirm your booking, we will try to find a replacement. If no driver is available, we reserve the right to cancel the contract without compensation.

You can only cancel or amend a confirmed booking if a driver is unavailable. In such cases, we will notify you via text, email, or push notification that your booking has been cancelled.

If we cannot accept your booking request, we will let you know and you will not be charged. Your contract with us ends once the journey is completed or as otherwise outlined in these Terms.

We will provide the total cost of the transportation service, including VAT, before you confirm your booking. This price may include additional fees such as airport pick-up and drop-off charges, tunnel tolls, parking, congestion charges, low-emission zone charges, or road tax.

In some situations, such as changes to your pick-up or drop-off location, traffic delays, waiting times, or stops during the journey, your final charge may differ. In such cases, the updated rates will be shared via the mobile app, website, phone, or email.

Rates and pricing may change from time to time. It is your responsibility to stay informed about current rates. You can also contact us directly via phone or email for pricing information.

Additional charges may apply if a passenger soils, damages, or contaminates the vehicle. In such cases, cleaning or repair fees will be charged.

Our accepted payment methods are listed on our mobile app and website. When you make a booking, we may request a temporary authorisation hold from your bank to verify your payment method.

For phone or email bookings, we will first confirm the journey details and total cost. Once confirmed, we will process your payment using an approved payment method.

If you believe there has been an error in the payment after the service is completed, please contact us promptly so we can investigate and resolve the issue.

CANCELLATIONS AND CANCELLATION CHARGES

Your right to cancel a Contract depends on when you decide to end the Contract, a reservation placed by the you, and can be cancelled only after its acceptance by the us. Such cancellation shall not be binding unless expressly agreed by us by email or calling our control office.
All cancellations initiated by you shall be subject to a cancellation fee, its exact amount depending on the length of the notice period given by you to Brown-hill Chauffeurs.
Brown-hill Chauffeurs reserves the right to charge the following cancellation fees:

100% OF THE QUOTED PRICE:

  • I. for notices given 0 – 3 hours (inside Greater London).
  • II. 0 – 24 hours (outside of Greater London) prior to the booked journey time.

50% OF THR QUOTED PRICE:

  • I. for notices given 3 – 24 hours (inside Greater London).
  • II. 24 – 48 hours (outside Greater London) prior to the booked journey time.
Non-contact by the Customer shall be regarded as a “no show” and shall be subject to a full cancellation fee (100% of the quoted price)
Full cancellation fee (100% of the quoted price) shall apply if the Company refuses to carry any of the items listed in clause.
All other cancellations are subject to the minimum cancellation fee of 12 pounds sterling.
If Brown-hill Chauffeurs is not at fault, you do not have a right to change your mind, you can still end your Contract, but you may be charged a cancellation fee in accordance with our cancellation policy.
To cancel your Contract by emailing us to bookings@brown-hillchauffeurs.co.uk Brown-hill Chauffeurs will make refunds due to you as soon as possible, where applicable.
Brown-hill Chauffeurs may end your Contract in certain circumstances, as provided for in these Terms. If Brown-hill Chauffeurs the Contract, Brown-hill Chauffeurs will refund any money you have paid in advance, but it may deduct or charge you as compensation for the net costs it incurs if you have broken the terms of the Contract.
Brown-hill Chauffeurs also provides to you certain booking services which include:
Accepting Bookings requested by you (which include Bookings requested in advance by you using the “future booking” by inputting future date and time and type of service is required but without prejudice to Brown-hill Chauffeurs rights at its sole and absolute discretion to decline any such request and/or cancel an accepted Booking.
Keeping records of Bookings, remotely monitoring transportation services booked using the Brown-hill Chauffeurs app; Receiving and dealing with feedback, questions, and complaints from you relating to Bookings accepted by Brown-hill Chauffeurs, which may be made available via customer app at when journey is completed and managing any lost property queries, (Together the “Booking Services”)

NO SHOW BOOKINGS

To avoid being billed for a ‘no-show’, customers should contact us immediately to our call control office on +44 7877 622145

Refund Policy

Refund Policy

Refund will be issued on the following grounds.
  • Booking on all credit/debit card notified 12 hours prior to the actual pick up time.
  • If the passenger missed the flight and informed us in advance either by phone or by email obtaining cancellation number.
  • All CREDIT/DEBIT card cancellations are subject to minimum cancellation fee of £5.00.
  • No refund will be issued for following.
  • If the passenger books the PHV for wrong date/wrong flight number and other misleading information.
  • If the passenger leaves the airport or any other agreed pick up address without informing us.

ISSUE/CONCERN WITH OUR TRANSPORTATION SERVICES

If there is a problem with BROWNHILL GROUP LIMITED, or if you have a complaint, please contact us on the details set out in the “About Us” section above.
Please note, that all private hire vehicles are required by law to hold and maintain PHV insurance for drivers to legally carry and transport passengers. If your problem relates to a motor incident, please contact us for your driver’s insurance details to progress matters. We will not be liable for any matters covered by your driver’s PHV insurance unless and until you have exhausted all potential remedies related to motor accidents
Brown-hill Chauffeurs, and its affiliate entities, are not liable for business losses. Brown-hill Chauffeurs Transportation Services are provided only for business or private use.

CORPORATE OR PRIVATE ACCOUNTS (ONLY FOR ACCOUNTS CUSTOMERS)

The Customer may open an Account with Brown-hill Chauffeurs are subject to credit check and approval, However, The Customer may open one of the 2 types of Accounts with Brown-hill Chauffeurs:

THE MONTHLY ACCOUNT

At the end of each month, Brown-hill Chauffeurs will send an invoice which has to be settled within 14 days from the issuing date. There is an account management fee of 6% if the invoice is settled by direct debit, Otherwise, the fee is 12%. The minimum administration charge will be £4.00 per invoice. 3% monthly interest might be applied for late payments

BUSINESS/PERSONAL DEBIT/CREDIT CARD ACCOUNT

You provide the card details and the cost of each transfer is debited form your card upon booking with a 2% card processing fee.
Account queries will only be considered if raised within our 14 days credit terms.
Upon completion of each journey the customer may be asked to sign a payment authorisation dock-et as a proof of the journey and for the approval of any journey extras.
Prices will be reviewed at the end of each calendar year.
Brown-hill Chauffeurs cannot be held responsible for the misuse of the account facility by the employees of the account.

GOVERNING LAW

The Contract shall be governed by the laws of England and Wales.

PRIVACY POLICY

You agree that we may use Personal information provided by you in order to conduct appropriate anti-fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

CHANGES TO THE TERMS & CONDITIONS

The Company reserves the right to revise the Terms and Conditions at any time, at its own discretion and without giving any prior notice to the Customer.

This copy of our current “Terms & Conditions” is issued to customers on opening an account with us and governs our general terms of business and revised “Terms & Conditions” will be circulated to account holders.
